Adventures in splel checking
(March 24th, 2006 under Fun Stuff )
Spell checkers are great, but are no substitute for a good human copy editor. Sometimes their misdeeds are more amusing than embarrassing. But in one California case, a spell checker with an poor grasp of Latin has created a unique legal doctrine.
The article notes that Arthur Dudley, a solo practitioner in Santa Cruz, California used the spell checker function which replaced "sua sponte" with "sea sponge" five times in his opening brief. This statement, "It is well settled that a trial court must instruct sea sponge on any defense, including a mistake of fact defense." and others was sent to San Francisco's 1st District Court of Appeal for review.
